Imigrantes e refugiados: o caso dos venezuelanos no Brasil durante a pandemia de Covid 19 - Um olhar jurídico

Abstract

O presente artigo parte da crise humanitária vivenciada na Venezuela que tem gerado o aumento significativo do número de solicitações de refúgio no Brasil. Nesse âmbito, o estudo trata da construção histórica pertinente às legislações nacionais e internacionais sobre imigração e refúgio. Assim, propõe-se uma reflexão a respeito dos desafios enfrentados para a aplicação das normativas no contexto da pandemia por COVID-19. A metodologia utilizada para a realização desta investigação é orientada por abordagens de pesquisa qualitativa, com o intuito de compreender o processo internacional do fluxo de refugiados venezuelanos que chegam ao Brasil e o procedimento metodológico é bibliográfico e documental, realizado a partir do levantamento de referências teóricas e documentos oficiais analisados e publicados. A pesquisa é de natureza básica com o objetivo de gerar novos conhecimentos para o avanço das discussões sobre a temática. Desse modo, pretende-se responder à seguinte pergunta: os imigrantes venezuelanos no Brasil são protegidos pelo instituto do refúgio durante a pandemia por COVID-19?

This article starts with the humanitarian crisis experienced in Venezuela that has generated a significant increase in the number of asylum requests in Brazil. In this context, the study deals with the historical construction to national and international legislation on immigration and refuge. Thus, it is proposed a reflection on

the challenges faced for the application of regulations in the context of the pandemic by COVID-19. The methodology used to carry out this research is guided by qualitative research approaches, in order to understand the international process of the flow of Venezuelan refugees arriving in Brazil and the methodological procedure is bibliographic and documentary, carried out from the survey of theoretical references and official documents analyzed and published. The research is of a basic nature with the objective of generating new knowledge for the advancement of discussions on the subject. Therefore, it is intended to answer the following question: are venezuelan immigrants in Brazil protected by the refuge institute during the pandemic by COVID- 19?
