O princípio da segurança jurídica e a modulação dos efeitos da alteração da jurisprudência do Tribunal Superior Eleitoral

Abstract

Neste trabalho o objeto central é abordar de que maneira a modulação temporal dos efeitos da alteração da jurisprudência concorre para dar concreção ao princípio constitucional da segurança jurídica, especificamente no que concerne à atuação do TSE. A segurança jurídica, um princípio que se aplica a todas as esferas de atuação estatal, traduz-se em diferentes perspectivas, como a previsibilidade, a estabilidade e a isonomia. E, considerando o maior poder interpretativo reconhecido atualmente ao Judiciário, produto de fatores como o neoconstitucionalismo e a adoção da técnica de cláusulas gerais na legislação, torna-se necessário implementar novas medidas dirigidas ao combate da inconsistência da jurisprudência. Com efeito, o novo CPC traz a noção de precedentes judiciais e proclama como um de seus objetivos a uniformização e estabilização da jurisprudência. Assim, para a segurança nas relações sociais e jurídicas, uma das técnicas de estabilização da jurisprudência é a aplicação da modulação temporal de efeitos da sua alteração no caso de se evidenciar uma confiança legítima a ser tutelada. Especificamente no âmbito do TSE se identifica uma importância destacada da segurança jurídica, inclusive pela finalidade do processo eleitoral de preservar a soberania popular e o Estado Democrático. Ademais, o exercício da função de orientação através das atividades jurisdicional, consultiva e normativa pelo TSE, e a capacidade e a possibilidade de as pessoas conhecerem a jurisprudência eleitoral, pressuposto para a formação da condição subjetiva da confiança legítima, favorecem a aplicação da modulação temporal de efeitos da alteração da jurisprudência. Aliás, mesmo anteriormente ao novo CPC, o TSE já aplicava a técnica. A aplicação da modulação temporal de efeitos da alteração da jurisprudência do TSE concretiza a segurança jurídica por meio da tutela da legítima confiança das pessoas.

In this research the central object is to discuss how the temporal modulation of the effects of the alteration of jurisprudence contributes to concretize the constitutional principle of legal security, specifically with regard to the TSE's performance. Legal security, a principle that applies to all spheres of state action, translates into different perspectives, such as predictability, stability and isonomy. And considering the greater interpretive power currently recognized to the Judiciary, as a result of factors such as neoconstitutionalism and the adoption of the technique of general clauses in legislation, it is necessary to implement new measures aimed at combating the inconsistency of jurisprudence. Thus, the new CPC brings the notion of judicial precedents and proclaims as one of its objectives the standardization and stabilization of jurisprudence. Thus, for security in social and legal relations, one of the techniques for stabilizing case-law is the application of temporal modulation of the effects of its change in the event of a legitimate expectation to be protected. Specifically within the scope of the TSE is identified a prominent importance of legal security, including the purpose of the electoral process of preserve popular sovereignty and the Democratic State. In addition, the exercise of the function of guidance through the judicial, advisory and normative activities by the TSE, and the capacity and the possibility of the people knowing the electoral jurisprudence, presupposition for the formation of the subjective condition of the legitimate expectation, favor the application of the temporal modulation of Effects of the amendment of the jurisprudence. In fact, even before the new CPC, the TSE already applied the technique. The application of temporal modulation of the effects of the change in the case law of the TSE provides legal security through the protection of the legitimate expectations of the people.
